Legal Research and Writing has no issue spotters to drill, but it absolutely has reps: the two skills that decide LRW grades, rule synthesis and sentence level editing, both improve through short, checkable exercises. This page is two of them, original, with model outputs to grade against. Drill one: rule synthesis (20 minutes)

Three squibs from the fictional state of Ames, all on a shopkeeper's privilege to detain suspected shoplifters. Kessler v. Marda's Market: detention upheld where a clerk watched the customer pocket items; the court noted the observation gave clear grounds and the fifteen minute wait for a manager was brief.

Tran v. Golden Gate Goods: detention unlawful where a security guard acted on a hunch about a nervous looking teenager; the court stressed that suspicion must rest on specific observed conduct. Ibori v.

Fairway Stores: detention upheld on strong suspicion, but the court warned that handcuffing the customer to a pipe for two hours would have defeated the privilege had the goods not been found, describing the manner and length as at the outer edge of reasonableness. Task: write the single synthesized rule sentence, with elements, that these cases collectively establish.

Model synthesis

In Ames, a shopkeeper may detain a suspected shoplifter without liability where the suspicion rests on specific observed conduct rather than generalized impression, and the detention is reasonable in both manner and duration, brief holds pending a manager or police being reasonable and prolonged or degrading restraint exceeding the privilege. Kessler supplies the observed conduct baseline and blesses brevity, Tran draws the specific conduct line against hunches, and Ibori attaches the manner and duration limit.

Grade yourself against three checks: one sentence stating the rule as law, not three sentences reporting cases; every element traceable to a squib; and the boundary language, specific observed conduct, reasonable in manner and duration, doing real work. The case by case report, Kessler held, Tran held, is the failure mode this drill exists to burn off.

Drill two: the editing pass (15 minutes)

Rewrite the following paragraph, which contains the course's three classic diseases, hedging, passive fog, and the buried rule:

It is arguable that the court might possibly find that the element of confinement could be considered to be met in this case. In Kessler, the customer was detained by the clerk for fifteen minutes. In Tran, the teenager was stopped by the guard near the exit.

It would seem that being kept in the office by Mr. Diaz could potentially be viewed as similar to what occurred in those cases, and therefore it is possible that confinement might be established.

Model rewrite

The confinement element is met. A customer is confined when a store employee restricts her movement to a bounded area, as when the clerk in Kessler held the customer for fifteen minutes and the guard in Tran stopped the teenager at the exit. Diaz did the same: he directed Ms.

Okafor into the office, closed the door, and stood before it for twenty minutes. Because her freedom of movement was restricted to a bounded space by a store employee, the element is satisfied.

Grade against four checks: the answer stated first, the hedges dead, every actor named as the subject of its verb, and the rule surfaced into its own sentence before the cases support it. Count your original paragraph's hedge words, arguable, possibly, could be considered, might, as a baseline; the rewrite should contain zero.

Making the reps compound

Both drills regenerate infinitely from your own coursework: any three cases from a research assignment become a synthesis rep, and any paragraph from your last draft becomes an editing rep, which is the honest secret of LRW practice, the assignments are the question bank. Run one synthesis and one editing rep weekly, log recurring failures into the comment log, and by the spring brief the two skills that rubrics weight heaviest will be reflexes rather than passes. The citation layer drills the same way: five minutes correcting the formats in an old draft against the quick sheet, and note that practicing on your professor's model memo, annotated move by move, is the highest grade rep of all.

FAQ

How is this practice different from just doing the assignment?

Isolation: the assignment exercises everything at once under deadline, while these reps train one muscle with immediate self grading, which is how skills actually consolidate. Fifteen isolated minutes beat an hour of undifferentiated drafting.

Can I practice on real cases instead of squibs?

Yes, and should, once comfortable: pull three short opinions on any narrow doctrine and synthesize. Squibs exist to remove the reading load so the synthesis muscle works alone at first.

Is it okay to use my graded memos as drill material?

It is the best material you own: every commented paragraph is a pre diagnosed editing rep. Just observe your school's rules when the memo later becomes a writing sample, revision within the permitted bounds only.
